This warranty explains the additional 10 year protection Horizon Stone Ltd offers for eligible silica free engineered stone slabs used in interior benchtops. It covers proven manufacturing defects in the stone material. Please inspect each slab before fabrication and contact us promptly if you find a concern.
Your legal rights
This warranty is in addition to rights you may have under the Consumer Guarantees Act 1993 (CGA) and other applicable New Zealand law. Its conditions and exclusions do not limit rights or remedies that cannot lawfully be excluded.
01. Who and What Is Covered
Horizon Stone Ltd (Horizon Stone) warrants that its silica free engineered stone slabs, supplied under the Horizon Stone brand for interior benchtop applications in New Zealand, will be free from manufacturing defects that materially affect their appearance or normal performance, subject to this document.
For this voluntary warranty, the original purchaser is the person or business named as purchaser on the Horizon Stone sales invoice. The voluntary warranty is not transferable. It does not cover porcelain, sintered stone, natural stone or conventional engineered stone, which have separate terms where offered.
10 year cover
If Horizon Stone supplies the product and arranges its installation, the period begins on the original installation date. If Horizon Stone supplies slab material only, the period begins on the delivery date shown by the sales record, whether the original purchaser fabricates it personally or engages another fabricator or installer. A later fabrication or installation date does not change the start date for a slab-only sale.
Please keep proof of purchase and the applicable installation or delivery date. Warranty registration is not required. Later owners and other people may still have rights under applicable law.
The product is intended for interior benchtops, including kitchen and bathroom vanity tops. Other uses, such as exterior surfaces, flooring, fireplaces, wet-area linings or wall cladding, require Horizon Stone to confirm warranty coverage in writing before supply. A product specification or a separate written agreement may state additional application requirements.
02. Inspect Before Cutting or Installation
The purchaser and fabricator or installer should inspect the slab in good ordinary lighting, on receipt and again before cutting. Check the finished face, edges, dimensions, colour, pattern, finish, batch and any visible chips, cracks, marks or other concerns against the order and approved sample. The appearance of adjoining slabs should be checked together before fabrication.
Any visible concern must be identified before fabrication. If a concern is found, stop work on the affected slab and notify Horizon Stone in writing before cutting or installation, with photographs, slab identification and purchase details. Give Horizon Stone a reasonable opportunity to assess the slab.
Once a slab has been cut or installed, claims under this voluntary warranty concerning pre-existing visual characteristics that could reasonably have been identified before fabrication may not be accepted. This does not affect rights under the CGA or claims concerning defects that could not reasonably have been discovered before fabrication.
03. Natural Visual Variation and Assessment
Differences in veining, colour tone, pattern placement and mineral distribution may occur between slabs, batches, samples, photographs and finished installations. These are inherent characteristics of manufactured stone and are not, by themselves, manufacturing defects. Ordinary minor surface variations must be assessed in the context of the chosen finish, normal viewing conditions and the overall appearance and use of the installed surface.
A claim will be assessed on evidence of a manufacturing defect, including its cause and effect on normal appearance, cleanability or performance. We may ask to inspect the product at a reasonable time. No fixed viewing distance, lighting test or photograph rule will override an assessment required by applicable law.
04. What the Limited Warranty Does Not Cover
Subject always to section 6, the additional voluntary warranty does not cover damage or concerns caused by:
- Fabrication by the purchaser or a third party, transport, storage, handling or installation, including poor cuts or polishing, edge profiles, seams and adhesives, unsuitable supports, cabinets or substrates, inadequate clearance around cut-outs, or movement of a building or cabinetry.
- Impact, scratching, chipping, excessive load, concentrated stress, heat or thermal shock. Use a chopping board and a trivet, and do not put hot cookware directly on the stone.
- Misuse, abnormal use, outdoor exposure, UV exposure, fire, flood or other external events, or use contrary to an application restriction or written product guidance.
- Abrasive or inappropriate cleaning, strong chemicals, solvents, paint removers, prolonged exposure to staining substances, or failure to clean and maintain the product reasonably.
- Unauthorised alteration or repairs, such as reworking, grooves, excessive thinning or repolishing, to the extent that they caused or contributed to the claimed problem.
- The non-decorative underside, which may differ from the finished face; a difference alone does not establish a defect.
The material is resistant to everyday wear but is not scratch proof, chip proof, crack proof, stain proof or heat proof. A crack, stain or other visible symptom is not automatically excluded: the cause will be assessed.
05. How to Make a Claim
Contact Horizon Stone through the contact details published at horizonstone.co.nz as soon as reasonably practicable after discovering the issue.
Please include:
- Name and contact details
- Invoice or proof of purchase
- Product name or code
- Slab or batch number, if available
- Installation or delivery date
- Overall and close-up photographs
- When the issue was first noticed
- How the surface has been used and cleaned
Preserve the affected material and allow reasonable access for inspection or testing if requested. We will assess the information fairly, tell you if more is needed and provide our decision and proposed next steps in writing.
Do not undertake a non-urgent replacement at Horizon Stone’s expense without discussing it with us first; this does not prevent urgent action to avoid further damage or affect statutory rights.
06. Remedies and New Zealand Consumer Rights
For a valid claim under this voluntary warranty, Horizon Stone will, acting reasonably, arrange a suitable repair, replace the affected slab material with the same or a reasonably comparable available product, or refund the purchase price of the affected slab material. A replacement may vary in shade or pattern and does not restart the original 10 year period. We will discuss the practical remedy with the claimant before proceeding.
As an additional voluntary warranty, this document does not promise to pay for fabrication, removal, transport, reinstatement, plumbing, electrical work, installation, project delay or other consequential costs, except to the extent applicable law requires otherwise.
Consumer Guarantees Act
The CGA may give a consumer remedies against the supplier or manufacturer, including for certain reasonably foreseeable losses, that go beyond this voluntary warranty. The CGA may continue to apply after this 10 year warranty ends. No warranty condition, including inspection, notice or non-transferability, limits those statutory rights.
For goods acquired in trade, any contracting out of the CGA must be separately agreed in writing and must meet the requirements of the law. This document itself does not contract out of the CGA.
07. Other Terms
Only a written statement issued by Horizon Stone can vary this voluntary warranty. A fabricator, installer or retailer cannot extend it on Horizon Stone’s behalf. The version supplied or made available when the product was purchased applies to that purchase; later updates apply prospectively unless a change benefits the purchaser or the parties agree otherwise.
